The Federal High Court sitting in Akure has ordered substituted service on Mr Adegboyega Adefarati in a suit seeking to nullify the primary election that produced him as APC candidate for Akoko South East/Akoko South West Federal Constituency in the 2023 general elections.
The plaintiff who was an aspirant for the primary Election ,Dr Olusegun Ategbole dragged Mr Adefarati, INEC and the state APC Chairman Mr Ade Adetimehin to court for allegedly not conducting the primary election in constituency.
Dr Ategbole alleged that lawful delegates were disenfranchised as the venue of the primary was moved to Akure for spurious claims.
Dr Ategbole said he brought the case before a court of law to ensure justice as a progressive democrat.
Delivering a ruling, Justice Demi Ajayi, ordered that Adefarati be served a substituted notice through the APC secretariat to appear in court in the interest of fair hearing.
Justice Ajayi held that there was need to ensure speedy hearing in the matter and ordered all parties involved to show seriousness.
She then adjourned the case till October 5th and 6th , 2022 for accelerated hearing.
Speaking with newsmen, counsel to the Plaintiff, Dr Remi Olatubora explained that the court ordered for substituted service so that there would be no complaint of shutting out anyone
