The Oyo State Deputy Governor, Rauf Olaniyan has on Thursday appealed the judgement dismissing his suit against the plan of the Oyo State House of Assembly to begin an impeachment process against him.
Counsel to Olaniyan, Chief Afolabi Fashanu confirmed the development on Thursday in an interview with the News Agency of Nigeria (NAN) in Ibadan.
NAN recalls that Justice Ladiran Akintola of the Oyo State High Court on Thursday dismissed the suit saying the defendants had not breached any constitutional provisions on the matter.
Fashanu said he had appealed the judgment dismissing his suit.
He said he was dissatisfied with the judgment and as a result lodged an appeal.
He appealed that the respondents should be restrained from taking any further steps pursuant to the purported notice of the allegations served on the claimant.
“We appeal for an order of injuction restraining the respondents from enforcing or implementing the judgment today.
“This is pending the determination of the appeal lodged against the said judgment.
“It’s expedient that an order of injuction be granted so that the outcome of the appeal will not be rendered nugatory,” he said.
NAN reports that Olaniyan, through his counsel, Afolabi Fashanu (SAN) had jointly taken the state House of Assembly; the Speaker, Mr Adebo Ogundoyin and the house clerk to court over the impeachment move against him by the lawmakers.
Fashanu had filled an application for the court to restrain the House from taking steps toward the deputy governor’s impeachment.
NAN recalled that Olaniyan, through his counsel, Afolabi Fashanu (SAN) had jointly taken the state House of Assembly; the Speaker, Mr Adebo Ogundoyin and the house clerk to court over the impeachment move against him by the lawmakers.
Fashanu had filled an application for the court to restrain the House from taking steps toward the deputy governor’s impeachment.
He prayed that the court should grant the originating summons, saying that the misconduct allegation against Olaniyan was vague and without particulars according to Section 188 of the 1999 constitution.
He remarked that an impeachment is a process and all the items listed in the Constitution should be strictly followed. (NAN)
